“Do I need to live in Miami to sue a cruise line?”
We’re often asked by clients if they need to live in Miami or live in Florida to sue a cruise line.
No. In fact, you can live anywhere. Filing a claim against a cruise line is not based on where you reside.
However, it is important to not the claims made against the cruise lines must be file in the appropriate venues. These venues or locations are spelled out in your Passenger Contract or your Ticket – the document you signed in order to take your cruise.
The cruise line will dictate where you – or more importantly your cruise ship injury attorney – will have to file suit. Where you file suit is up to the cruise line, not up to you or your attorney.
Most cruise lines are based in Florida – Miami, Ft. Lauderdale and Orlando (though some are in Seattle, WA and Los Angeles, CA). That might be the reason for the confusion and questions we receive.
Though you can reside anywhere and hire an attorney from anywhere, you’ll want to hire a cruise lawyer who works within the area where your claim needs to be filed. While this is not always the case, it make the legal process easier and more efficient.
