Even Disney Cruise Lines is not immune to injury claims, this time from a longshoreman who was hurt while working to transfer cargo from the cruise ship to a tractor trailer.

Here are more details as related in an article from the Southeast Texas Record, Southeast Texas’ Legal Journal…

A longshoreman is suing over claims he was injured transferring cargo from a cruise ship.

Daniel Wayne Edwards filed a lawsuit Nov. 26 in Galveston County District Court against Magical Cruise Company Limited, doing business as Disney Cruise Lines; GRS Logistics Inc.; Daniel Edwards Arrington; and Chris Large, citing negligence.

According to the complaint, on Dec. 29, 2012, Edwards was working as a longshoreman driving a forklift to transfer cargo from the M/V Disney Magic cruise ship into a tractor-trailer parked at the loading dock of Pier 28 in the port of Galveston under the supervision of Disney Cruise employee Large.

The complaint states Arrington, who was driving the tractor-trailer for GRS Logistics, was standing some distance away not paying attention as Large instructed Edwards to drive across a heavy metal loading plate spanning the gap between Arrington’s tractor-trailer and the loading dock. The lawsuit states Arrington pulled his trailer away from the dock, causing Edwards and his forklift to fall to the ground and Edwards to sustain injuries.

Edwards is represented by attorneys Richard L. Lagarde and Mary Ellis Lagarde of Lagarde Law Firm in Houston.

Generally, our firm – Waks and Barnett, P.A. – represents passengers injured on cruise ships, including Disney, but also Carnival, Norwegian, Royal Caribbean and others.

While this is not our firm’s case, it will be interesting to see how this injury claim from a longshoreman plays out. Proving negligence in an incident like this can proved difficult.
