Were you injured on a Disney cruise ship?

When you sail on a Disney cruise ship, you’re actually sailing with the Magical Cruise Company, Limited (which legally does business as Disney Cruise Line). Cruise vacations are part of the Disney Experience division which also includes Disney theme parks. It’s cruise ships are like floating theme parks and carry hundreds of thousands of visitors each year.

While most Disney Cruise Line travelers enjoy their vacation, some do not. Some passengers are involved in accidents and suffer serious injuries. And sometimes, Disney is held accountable for those accidents.

Were you hurt while on a Disney cruise vacation? Did you slip by the pool? Were you hurt in your cabin? Did you suffer an injury while on a tender boat or an excursion planned by the cruise line?

If so, Disney Cruise Line might be responsible for your injuries.

What happens after a Disney cruise accident?

Many passengers don’t even realize that the cruise line might be liable for injuries sustained while on the cruise.

You may also not know that by filing a claim (assuming it can be proven the cruise line or its employees were negligent in their actions or policies) you may be able to get a settlement or verdict against Disney Cruise Line that will help pay for medical bills, missed time at work and other compensatory and punitive damages.

If you believe you have a claim against Disney Cruise Line – or even if you’re unsure about your options – you should speak with an attorney.

Quite frankly, most people don’t know what to do if they’ve been involved in an accident. At first, most people focus their attention on getting proper medical treatment and going through rehab and recovery for their injuries. And you should.

It’s generally only when the medical bills start to pile up that passengers think about filing an injury claim or begin to seek the help of an attorney. This is when it’s time to contact a lawyer. We can help you file a claim (or take over if you’ve been frustrated with the process of filing an injury claim against Disney yourself).

How much is a Disney Cruise Line injury lawsuit worth?

This is an important question asked by cruise ship accident victims. “If I sue Disney, how much money can I get for my injuries?”

The simple answer is – it depends. Each and every cruise accident or injury is different. And, until an attorney knows the details of your specific case and begins to investigate your claims, there is no easy answer.

Our experienced attorneys will help you navigate the injury claim and lawsuit, any settlement negotiations that occur and will advise you on your chances of success in the courtroom for an injury verdict if a settlement offer is not desirable to you. Cruise ship injury settlement amounts can range from just a few thousand dollars to tens of thousands of dollars or even millions of dollars depending on the severity of your injuries and the factors involved with your case.

Our Disney cruise lawyers are absolutely determined to get you the compensation you deserve for your injuries. Over the past 35 years, we’ve achieved numerous, positive settlements and verdicts after cruise ship accidents for the benefit our clients, including:

  • $192,500 for a broken wrist due to a slip and fall on a wet deck.
  • $410,000 for 43 year old man who broke his ankle from a slip and fall on wet bathroom floor.
  • $450,000 for brain damage related to misdiagnosis by the ship’s doctor after a stroke.
  • $1.2 million in recovery after a fall from a poorly maintained stairway.

Confused about your legal rights after a Disney cruise ship accident?

Most Disney cruise accident victims are confused about what their rights are – and how to pursue legal action against the cruise line. Was it a simple accident or was the cruise line at fault? What were the circumstances of the accident?

Our experienced Disney cruise attorneys can help you determine who was at fault, if the cruise line or its employees were negligent in their actions and if that negligence led to your injuries.

How do I file an injury claim against Disney Cruise Line?

Going up against a big cruise line like Disney by yourself may not end the way you want.

All personal injury cases are complex, but those involving the cruise lines and maritime laws can be even more complex. It’s why there are only a handful of attorneys and law firms that handle cruise ship injury cases.

While some people will try to file an injury claim directly with Disney Cruise Line, the best way to protect your rights is with help from an experienced cruise injury law firm.

If your goal is to file an injury claim against Disney Cruises, you must read and abide by the terms and conditions laid out in the Ticket Contract that you signed and accepted prior to boarding the cruise ship.

Our attorneys can help you understand whether you have grounds for a claim, where to file the claim (what city and which court), and how best to negotiate a settlement with a cruise line or insurance company – or whether to go to trial.

Where do I file an injury claim against Disney Cruise Line?

The Disney Cruise Line Ticket Contract (Magical Cruise Company, Limited) is important as it outlines where injury claims must be filed (the proper court of law and location of the court / forum selection clause) – and the time frame in which the claims must be brought. Disney Cruises’ United States operational headquarters is located at 210 Celebration Place, Kissimmee, FL 34747. The European Registered Office is at 3 Queen Caroline Street, Hammersmith, London, W6 9PE, United Kingdom.

Disney’s passenger ticket contract only allows for injury claims and subsequent lawsuits to be brought in state court within Brevard County, Florida or federal court in Orlando, Florida.

Ticket contracts from the cruise lines are notoriously difficult to understand. Even attorneys can struggle with the language, terms and conditions of cruise line ticket contracts if they are not experienced with cruise ship injury law and the particulars of maritime law. Remember – the cruise lines will make it as difficult as possible for passengers to file injury lawsuits against them. It’s why hiring experienced cruise ship injury lawyers is so important to the success of your case.

THIS CRUISE CONTRACT IS A LEGALLY BINDING CONTRACT, WHETHER OR NOT SIGNED BY GUEST OR GUEST’S RESPONSIBLE ADULT. IT IS ISSUED BY CARRIER BASED ON THE GUEST’S ACCEPTANCE, INDIVIDUALLY OR THROUGH GUEST’S RESPONSIBLE ADULT, ALWAYS SUBJECT TO THE TERMS AND CONDITIONS SET OUT THEREIN. THE GUEST AND RESPONSIBLE ADULT SHOULD PAY SPECIAL ATTENTION TO CLAUSES 9 THROUGH 23, INCLUDING THE CLASS-ACTION WAIVER IN CLAUSE 12, WHICH LIMIT THE RIGHTS OF GUEST AND EXCULPATE FROM LIABILITY THE CARRIER, THE VESSEL AND ANY OF THEIR AGENTS, EMPLOYEES OR CONTRACTORS.

The United States Supreme Court has previously upheld the limitation of forum clauses printed with or on the back of passenger tickets in Carnival Cruise Lines, Inc. v. Shute. This court decision affects all cruise lines including Disney Cruise Line.

This concept of Venue Selection that is dictated by Disney can be confusing to passengers who are attempting to sue the cruise line? If you live in Pennsylvania, and your Caribbean cruise to Mexico departed from Port Canaveral, Florida – why does a law suit have to filed in Brevard County in Florida? The simple answer is that Disney’s ticket contract dictates this – and you agreed to it when you signed the Ticket Contract before boarding. Importantly, in many cases, you would not have to travel to Florida during the lawsuit. Our attorneys can work with you virtually, over the phone, by email and by regular mail. If you would be required to travel to Florida for any reason, our attorneys would advise as to why.

What are the Statute of Limitations when filing a lawsuit against Disney Cruise Line?

Disney’s ticket contract also tells when injury claims and lawsuit need to be filed. Abiding by these dates are important and missing them could very well impact your ability to sue the cruise line. Courts have continually upheld this statute of limitations against Disney Cruise Line and other cruise lines and have dismissed injury claim cases leaving injured passengers without an ability to sue for damages even if the cruise line was at fault.

Disney Cruise Line must receive notice of injury claims within 6 months of the injury occurring and lawsuits must be filed within 1 year.

NO SUIT SHALL BE MAINTAINABLE AGAINST CARRIER OR THE VESSEL FOR DELAY, DETENTION, PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, MENTAL SUFFERING, PSYCHOLOGICAL INJURY OR DEATH OF THE GUEST, UNLESS WRITTEN NOTICE OF THE CLAIM WITH FULL PARTICULARS BE DELIVERED TO THE CARRIER AT ITS OFFICE AT THE ADDRESS SET FORTH HEREIN WITHIN SIX (6) MONTHS FROM THE DAY THAT THE EVENT THAT CAUSED SUCH DELAY, DETENTION, PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, MENTAL SUFFERING, PSYCHOLOGICAL INJURY OR DEATH OF THE GUEST OCCURRED; AND IN NO EVENT SHALL ANY SUIT FOR ANY CAUSE AGAINST THE CARRIER OR THE VESSEL WITH RESPECT TO DELAY, DETENTION, PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, MENTAL SUFFERING, PSYCHOLOGICAL INJURY OR DEATH BE MAINTAINABLE, UNLESS SUIT SHALL BE COMMENCED (FILED) WITHIN ONE (1) YEAR FROM THE DAY THAT THE EVENT THAT CAUSED THE DELAY, DETENTION, PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, MENTAL SUFFERING, PSYCHOLOGICAL INJURY OR DEATH OF THE GUEST OCCURRED, AND PROCESS SERVED WITHIN ONE HUNDRED TWENTY (120) DAYS AFTER FILING, NOTWITHSTANDING ANY PROVISION OF LAW OF ANY STATE, TERRITORY, POSSESSION OR COUNTRY TO THE CONTRARY.

Again, experienced Disney cruise accident lawyers will be fully aware of these requirements and can help you collect the information needed to file a lawsuit. However, it’s imperative that cruise ship accident victims don’t wait to speak with an attorney if they believe the cruise line was responsible for their injuries.

Sue for slip and fall accidents on a Disney cruise ship

Disney Cruises is obligated to keep areas of the boat free from hazards and alert passengers as well as employees about dangerous conditions. When the cruise line or its crew members fail to perform their duties to passengers correctly, the responsibility of the slip and fall injury may fall on the cruise line operating the ship.

Slipping, tripping and falling is the most common reason for passengers inquiries to our law firm. These types of accidents lead to broken arms and legs, broken hips, cracked ribs, concussions, lacerations and internal injuries. While some accident victims sustain minor injuries, the pain, inconvenience and associated medical bills can still be substantial. And certainly, passengers suffer from more severe injuries that may impact their quality of life.

Passengers want to know if the accident is their fault – or is the fault due to negligence? Was Royal Caribbean responsible for your injuries?

The details of your accident are very important and will help determine who was at fault and what a potential financial compensation from the cruise line could be.

Our firm has been able to recover substantial amounts for our clients who were hurt in slip and fall accidents while traveling with Disney Cruise Line and other cruise lines, including:

  • $225,000 for 58 year old woman who fractured her ankle from fall on wet stairs.
  • $210,000 for 47 year old man who broke his ankle from fall on wet deck.
  • $212,500 for 39 year old woman who tore ligaments in her knee from fall on wet deck.
  • $5,500,000 for 14 year old boy who suffered a head injury in a fall on a stairway.

Medical negligence and misdiagnosis by Disney Cruises doctors

We’ve represented many Disney Cruises passengers who were victims of medical malpractice, misdiagnosis and negligence by the cruise ship’s doctors, nurses and medical staff. When Disney Cruises doctors make mistakes, they and the cruise line can be held accountable and a financial recovery can be made.

Injuries caused by medical negligence – or made worse by – are often complex and difficult to prove without the help of an attorney.

It’s why experience matters greatly in these types of cases. Our cruise ship medical negligence lawyers understand how the cruise lines operate and how to best move a potential medical malpractice case forward, from initial claims to eventual settlement.

Hurt on a Disney Cruises shore excursion or tour?

Yes — Disney Cruises can have a responsibility for the safety and well-being of their passengers — even once they’ve been let out in Alaska, Mexico or a Caribbean Island.

However, the cruise lines are known to not accept blame for personal injuries that happened to their passengers who were hurt on an excursion.

Their reasoning? It wasn’t their fault the tour operator didn’t do something correctly, didn’t follow a rule or was operating a faulty vehicle. Their goal is to shift blame and limit the claims and lawsuits filed against the cruise line so that they don’t have to pay for bodily injury, doctor’s bills, missed time at work, pain and suffering, future medical bills, loss of life or other things that limit your ability to live life as you did before the cruise. Yet, Disney Cruises actively promotes dozens and dozens of tours around the world.

Were you hurt in a tour bus accident? Injured while parasailing? Suffer from injuries during a diving excursion or while horseback riding? Contact our Disney Cruises excursion lawyers today.

Injury Accidents on Disney's Private Islands

Disney has two private destinations in the Bahamas for its cruise ship passengers – Disney Castaway Cay and Disney Lookout Cay. Both offer what should be a relaxing port of call.

However, just like anywhere else, a Disney guest may be involved in a painful accident or negligence may play a role in a serious injury. When this happens, these guests may have a reason to hold Disney accountable.

You can file an injury claim after a Disney private island accident. And you can potentially receive compensation for those injuries if Disney was proven to be at fault. Our attorneys can help.

Disney cruise ship tender accident lawyers

Tender vessels are much smaller than the cruise ship and with the movement of the ocean, the tender can bang up against the cruise ship causing injuries to occur. The same thing can happen as the tender navigates around other boats in a busy port or attempts to dock. The experience of the crew piloting the tender can also play a role in the safety of the passengers. If you were involved in an accident while aboard a cruise ship tender, please contact us to talk about your injury. Our phone number is 1-305-271-8282.

Disney Cruises sexual assault and rape lawyers

If you were a victim of a sex crime while on a Disney cruise, we’d like to hear your story. Our attorneys will speak with you confidentially and will work to help you build a successful case against the person who abused you as well as the cruise line.
