Windstar Cruise Injury

Injured on a Windstar Cruise?

Were you injured on a Windstar cruise? A serious injury can leave you facing medical bills, missed work, and questions about your recovery. Waks & Barnett, P.A. can review what happened, explain your legal options, and help you pursue compensation when negligence caused your injuries.
Our Miami cruise injury attorneys work with passengers from across the country. We investigate the circumstances of the accident and review the ticket requirements that may affect your claim.

Compensation After a Windstar Cruise Injury

An injury claim may include medical expenses, lost income, pain and suffering, and the effects of a lasting disability.

The compensation available depends on the evidence, the severity of your injuries, and the law that applies to your case.

Injured While Traveling With Windstar Cruises

Windstar offers cruises aboard sailing yachts and motor yachts. A smaller ship can still present serious safety concerns when a deck is slippery, a stairway is poorly maintained, or passengers are not properly assisted during boarding or a tender transfer.

An injury does not automatically mean the cruise line is responsible. Our attorneys examine how the accident occurred, who controlled the area or activity, and whether a failure to use reasonable care caused or contributed to your harm.

Slip and Fall Accidents on Windstar Ships

A fall may involve water on a deck, a slippery bathroom floor, a change in walking surface, inadequate lighting, or a damaged step or handrail. Photographs of the precise location and the condition that caused the fall can be important.

We review maintenance and cleaning practices, available warnings, witness accounts, and whether the cruise line knew or should have known about a dangerous condition when that issue is relevant to the claim. Falls can cause fractures, knee and shoulder injuries, head injuries, and other lasting harm.

Tender Boat and Gangway Injuries

Getting between a ship, tender boat, and dock can be difficult when the vessels move or the walking surfaces do not line up. An unsafe transfer, inadequate assistance, a sudden vessel movement, or a defective gangway may cause a passenger to fall or suffer a crushing injury.

Our review may include the sea conditions, boarding procedures, crew assistance, equipment, and the decisions made before and during the transfer.

Shore Excursion and Watersports Injuries

If you were injured during an excursion or watersports activity connected with your cruise, save the booking confirmation, activity description, waivers, and names of the businesses involved. Responsibility may depend on who operated the activity and what role Windstar played in selecting, promoting, or supervising it. A claim against the cruise line or another operator requires a separate assessment of the facts and applicable law.

Medical Negligence and Other Serious Injuries

If you believe medical care during your cruise caused additional harm, preserve the treatment records and a timeline of your symptoms and requests for assistance. We can review concerns about delayed evaluation, misdiagnosis, treatment, and arrangements for care ashore. Liability depends on the medical evidence, the providers involved, and the governing law.

We also review serious injury and wrongful death inquiries, including injuries involving unsafe equipment or alleged failures in passenger security. Survivors of sexual assault can contact our attorneys for a confidential discussion of their legal options.

What to Do After a Windstar Cruise Accident

If you can do so safely, photograph the accident location, the condition that caused the injury, any warnings, and your visible injuries. Keep the original photographs and videos. Record the names and contact information of witnesses and the crew members who assisted you.

Save your passage contract, itinerary, booking documents, excursion receipts, medical records, and communications with Windstar. Keep a record of follow-up treatment, missed work, and expenses. Contact an attorney promptly so that important evidence, including any available surveillance footage, can be requested before it is lost.
Seek appropriate medical attention and report the accident to the ship’s staff as soon as possible. Ask for copies of any incident report or statement you provide, as well as your onboard medical records and bills.

How Much Is a Windstar Injury Case Worth

There is no standard settlement amount. The value of a claim depends on whether liability can be established, the medical diagnosis, treatment and future care needs, lost earnings, and the impact of the injury on daily life. Any applicable limits on recovery must also be considered.

Our attorneys can discuss those issues after reviewing your circumstances. No lawyer can promise a particular settlement or verdict.

Windstar Ticket Deadlines and Where to File Suit

Windstar’s published May 2026 passage contract states that personal injury, illness, and death claims require written notice with full particulars within six months and a lawsuit within one year of the injury, illness, or death. Reporting an accident onboard should not be assumed to satisfy the formal notice requirement.

The same contract selects Miami courts for injury, illness, or death lawsuits when the planned itinerary includes a U.S. or territorial port. It specifies the federal court in Miami, with a Miami-Dade court fallback when federal subject matter jurisdiction is lacking. For itineraries without such a port, it selects the courts of England and Wales.

Your own contract, itinerary, applicable law, and any exceptions must be reviewed. Do not wait for treatment to end or settlement discussions to conclude before seeking advice.
