Bimini SuperFast Passenger Trips on Threshold

Attorneys Andrew Waks and Jennifer Thompson obtained a favorable verdict for a 61 year old Michigan woman who tripped and fell over a threshold in a ship’s doorway while on a 2 day cruise to Bimini.

Because of the fall, the passenger fractured her wrist and had to undergo surgery to repair the damage.

The critical issue in the case was whether there were signs on the door warning of the presence of the threshold.

Fortunately, the incident was captured on video. Our firm presented the testimony of a forensic video expert who broke down the videotape frame by frame and told the jury that at least some of the signs the cruise company claimed were on the door probably were not.

The jury found the cruise company 65% at fault and awarded damages of $361,000, which resulted in a 235,000 net verdict to the Plaintiff after reduction for comparative negligence.

Carnival Passenger Claims She Was Injured From Fall During Excursion

The plaintiff alleges that on April 8, 2016, she slipped and fell due to the wet and slippery floor on the defendant’s ship Breeze. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to put up warning signs to warn the plaintiff of the slippery floor and failed to maintain the deck in a reasonably safe condition. Carnival Passenger Accuses Cruise Line of Negligence After Fall

According to the complaint, the plaintiff and her husband were passengers on the Carnival ship Valor and purchased a boating excursion with Ocean Vibes. The plaintiff alleges that on Dec. 15, 2015, she sustained serious physical injuries as the result of falling because the defendants’ employees did not safely assist her from getting to the vessel to the dock. According to the complaint, the plaintiff alleges that in October 2015, she sustained physical injuries on the defendant’s ship Magic when the ladder for the bunk bed in her cabin caused her to fall. Mother Alleges Child Was Injured on Metal Strip In Carnival Ship’s Cabin

According to the complaint, the plaintiff alleges that on Sept. 23, 2015, Leah Johnson sustained physical injuries and permanent scarring when she tripped and fell onto a metal strip while on the defendant’s ship. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to properly warn its passengers regarding the hazardous condition aboard its vessel. Carnival Passenger Claims He Was Injured Because of Ship’s Frayed Carpet

According to the complaint, the plaintiff alleges that on Sept. 16, 2015, he sustained physical injuries from tripping on a frayed carpeted floor while traveling on the defendant’s ship Imagination. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to properly warn the plaintiff regarding the hazardous condition and for allowing the condition to exist. According to the complaint, the plaintiff alleges that, on Nov. 1, 2015, she sustained physical injuries when the luggage in front of her fell toward her. According to the complaint, the plaintiff alleges that in May 20, 2015, she suffered physical injuries when she slipped and fell due to a substance left on the floor in the dining room of the ship Paradise. She alleges the incident caused a torn meniscus in her knee. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to provide adequate warning regarding the hazardous condition of the floor and allowing the condition to exist. Man Claims Carnival Cruise Ship Massage Caused Herniated Disc

According to the complaint, the plaintiff alleges that in July 2015, he experienced pain after getting a hot rock massage by Steiner on the Carnival cruise ship, which was later determined to be caused by a herniated disc that needed surgery to fix. The plaintiff holds Carnival Corp. and Steiner Leisure LTD responsible because the defendants’ employee was too aggressive with the manipulations of the plaintiff’s neck during the massage and that negligence caused the plaintiff’s injuries. According to the complaint, the plaintiffs allege that on Aug. 8, 2015, Michael MacDonald sustained injuries when he slipped and fell while aboard the defendant’s cruise ship Breeze’s Sky Course. The plaintiffs hold Carnival Corp. responsible because the defendant allegedly failed to provide adequate warning and supervision for minors using the Sky Course aboard its vessel. Royal Caribbean Cruise Passenger Alleges Injuries on Waterslide

According to the complaint, the plaintiff alleges that on May 25, 2015, he sustained physical injuries when another rider on the slide ran into him. The plaintiff holds Royal Caribbean responsible, because the defendant allegedly failed to control people going down the slide or provide adequate warning to the plaintiff. Passenger Filed Suite Against Carnival for Alleged Trip and Fall Injuries

According to the complaint, the plaintiff alleges that on May 11, 2015, she sustained physical injuries when she tripped and fell due to a raised piece of metal on the floor of the vessel Miracle. UK Citizen Alleges Injury From Wave Runner Tour

According to the complaint, the plaintiff and the defendant were passengers on the cruise ship Freedom of the Seas. The plaintiff alleges that on March 4, while the ship was docked at Labadee, Haiti, she was broadsided by the defendant while on a wave runner tour, causing serious injuries. According to the complaint, the plaintiff alleges that, on Jan. 10, she slipped and fell on the steps as she was exiting the hot tub on Deck 10 on the ship Dream, resulting in a fractured femur in her left leg. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to warn her of the dangerous condition of the surface and failed to remedy such condition, despite prior knowledge of same. Carnival Cruise Ship Passenger Sues for Alleged Injury

The plaintiff alleges that, on Jan. 18, 2015, she was struck from behind by a poker machine that was being moved by a crew member. The plaintiff holds Carnival Corporation responsible because the defendant’s crew member allegedly failed to properly secure the poker machine to the cart while being transported, allegedly failed to have an assistant to prevent the poker machine from falling off, and allegedly moved the machine at a time when it had to be maneuvered around passengers in the casino.
